Main Responsibilities of the Legislative Affairs Office of the People’s Government of GuangZhou Municipality:
1. Implementing the policies, strategies, laws and regulations of the State on legislative affairs administrations of the government; formulating the annual legislation plan of the municipal government, and putting them into effect after being approved.
2. Formulating, revising, examining and approving drafts of rules and regulations both of local and municipal government, and coordinating the existing contradiction in the process of drafting.
3. Taking charge of the explanation of rules and regulations of the government; clearing off or compiling local rules, regulations and administrative regulatory documents, and translating, examining and approving the corresponding foreign languages’ versions.
4. Fulfilling the tasks of drafts consultation of laws, rules and regulations required by NPC and its committee, State Council and its various branches, Guangdong People’s Congress and its committee, the Provincial Government and its various branches.
5. Issuing the policy-related documents, decisions and administrative measures involving important legal problems required by the Municipal Government, or examining their legitimacy before being put into effect; carrying out the decisions of serious administrative punishments made by the various departments of the Municipal Government and People’s Government of cities of county level; and putting on file and examining the regulatory documents.
6. Taking responsibility for the inspection of administrative enforcement of laws according to related rules and regulations; supervising and implementing the Managerial Ordinances for the Staff of Enforcement of Administrative Laws of Guangdong Province; approving, issuing and supervising the use of the Certificate for Enforcement of Administrative Laws; implementing administrative punishment and coordinating the contradiction and disputes among different departments in the process of implementation of laws, rules and regulations.
7. Coordinating and supervising the important activities of enforcement of administrative laws; taking responsibility for investigating an prosecuting the appeal cases in terms of enforcement of administrative laws; taking charge of the safety and order of roads and highways; coordinating and guiding the administration of comprehensive law enforcement; taking charge of the training, certificate issuing, examining and supervising those who’re responsible for the comprehensive law enforcement; taking charge of investigating and prosecuting the appeal cases in terms of enforcement of administrative laws and infringement of managerial authority of enterprises.
8. Taking Responsibility for cases in terms of administrative reconsideration and administrative compensation applied to the Municipal Government; acting for the Municipal Government regarding administrative response; guiding the administrative reconsideration, administrative response and administrative compensation of the whole city; and taking responsibility for the compulsory building demolition of the city.
9. Developing a research and exchange program with respect to the government’s legislative affairs theories and enforcement; and carrying out foreign exchange of legislative affairs.
10. Undertaking other tasks assigned by the municipal government and legislative affairs departments at higher levels.
